14.01 COOK COUNTY ANIMAL AND RABIES CONTROL ORDINANCE

There is hereby adopted by the City of Hickory Hills for the purpose of promoting the public safety, health and welfare, the Cook County Animal and Rabies Control Ordinance with the following exceptions and changes:

(a) "County" or "Cook County" shall mean the City of Hickory Hills.

(b) "Administrator" shall mean the Animal Control and Welfare Officer of the city.

(c) Sections 20-11A, 20-12A, 20-13, 20-16, 20-17, and 20-18 are deleted and not adopted.

14.02 LIMITATION OF NUMBER OF DOGS AND CATS

It shall be unlawful to keep or maintain more than two dogs or two cats of two months of age or older in any single-family residence, building or lot or to keep or maintain more than one dog or one cat of two months of age or older In any family unit of a multi-family residence or in a business establishment within the city. This section shall not apply to licensed pet shops, animal hospitals, animal grooming establishments, or kennels.

14.03 DOG AND CAT LICENSE

Every owner of, and every person who harbors or keeps a dog or cat within the limits of the City of Hickory Hills, shall report to the City Clerk annually within 30 days after the first day of May his or her name and address, and the name, breed, color, sex and age of each dog or cat owned or kept by such person. Such person shall also present to the City Clerk at that time a current identification that such dog has been innoculated for rabies in compliance with the ‘Illinois Rabies Control Act.’ An annual license fee of $2 per dog or cat shall then be paid to the City Clerk. All such licenses shall expire on the 30th day of April next following issuance.

14.04 LICENSE TAGS

No dog or cat shall be permitted to be or remain In the City of Hickory Hills without being licensed as provided for herein. Upon issuing a license to keep any dog or cat, the City Clerk shall issue to the owner a durable tag or identification collar, stamped with an identifying number and with the year of issuance. Tags should be so designed that they may be conveniently fastened to the dog’s collar or harness. Dogs or cats must wear identification tags or collars at all times when the animal is off the premises of the owner. The City Clerk shall maintain a record of the identifying numbers and shall make this record available to the public.

14.05 DOGS OR CATS AT LARGE, IMPOUNDMENT

(a) No person maintaining a dog or cat within the City of Hickory Hills shall permit such dog or cat to run at large within the city. All dogs or cats while remaining on the owner’s property, while outside of the dwelling unit, shall be kept within the confines of a fenced in yard or enclosure. All dogs or cats taken off the owner’s property shall at all times remain on a leash.

(b) Unrestrained dogs or cats may be taken by the police and impounded in an animal shelter and there confined In a humane manner. Impounded dogs or cats shall be kept for not less than 5 days unless reclaimed by their owners. If by a license tag or other means the owner can by identified, the Police Department shall immediately upon Impoundment notify the owner by telephone or mail of the Impoundment of the animal. Dogs or cats not claimed by their owners within 5 days, or placed in suitable new homes, shall be humanely euthanized at the direction of the Police Department or by an

(c) An owner reclaiming an impounded animal shall pay a fee of $hO, plus $h.00 for each day that the animal has been impounded.

(d) In addition to, or in lieu of, impounding an animal found at large, the Police Department may issue to the known owner of such animal a notice of violation in accordance with the ordinances of the City of Hickory Hills.

(e) It shall be unlawful for any female dog to run at large while in heat. Every female dog in heat shall be confined in a building or secure enclosure. Any female dog in heat running at large in the city may be impounded by any police officer of the city or by the Animal Control and Welfare Officer.

14.06 RABIES VACCINATION

It is the duty of all persons owning or keeping a dog over 4 months of age to have such dog vaccinated against rabies. The rabies vaccination shall be given in an amount sufficient to provide immunities from rabies for one year and shall be administered by a licensed veterinarian. A certificate from a licensee veterinarian shall be furnished the City Clerk. If the rabies inoculation is effective for a period in excess of one year, the certificate shall so state.

14.07 ANIMAL BITES

The Police Department shall cause to be investigated reports of animal bites. If an animal has bitten a person, the Police Department shall notify the owner of the animal and the animal shall be delivered promptly to a licensed veterinarian who shall confine or cause to be confined such animal as provided in the Animal Control Act of Illinois. If the owner is not known, the police officer shall take such animal promptly to a licensed veterinarian to be confined as provided in the Animal Control Act of Illinois.

14.08 ANIMAL CARE AND MISCELLANEOUS OFFENSES

(a) Each person who has (A) a right of property in an animal, (B) keeps an animal or (C) has an animal in his care or custody, or (D) who knowingly permits an animal to remain on or about any premises occupied by him, shall provide for each of his animals:

1. Sufficient quantity of good and wholesome food and water;

2. Adequate shelter and protection from the weather;

3. Veterinary care when needed to prevent suffering; and

4. Humane care and treatment.

(b) No person as described in this section shall permit or suffer his animal to:

1. Molest persons or vehicles by chasing or barking or biting;

2. Attack other animals;

3. Damage property other than that of the owner;

4. Bark, whine or howl excessively;

5. Create noxious or offensive odors.

14.09 RESPONSIBILITY FOR REMOVAL OF EXCRETA

The owner of every animal shall be responsible for removal and sanitary disposition of any excreta deposited by his animal anywhere in the city. When accompanying the animal outside his premises, he shall have on his person suitable means for the removal of such excreta.

14.10 PROHIBITED ANIMALS

It shall be unlawful to keep any pigs, swine, sheep, cattle, horses, goats or similar animals, or any naturally wild animals, except birds or fish, within the city except in horse stables, educational institutions, veterinary hospitals or animal shelters.

14.11 ANIMALS AS DOOR PRIZES OR AS ATTRACTIONS FOR TRADE

It shall be unlawful for any person to give away any live vertebrate animals as a prize for, or as an inducement to enter any contest, game or other competition, or as an inducement to enter a place of amusement; or offer such vertebrate as an incentive to enter into any business agreement whereby the offer was for the purpose of attracting trade.

14.12 FIERCE DOGS

If any owner, or keeper or possessor of a fierce or dangerous dog shall permit the same to be at large in any of the streets, alleys or other public places, or upon property belonging to any other person other than the owner, keeper or possessor of such dog, to the danger or annoyance of any of the inhabitants of the city, such owner, keeper or possessor shall forfeit and pay for the first offense a sum not to exceed $100. Upon a second conviction for the same offense, the Police Department shall immediately cause the dog, upon account of which conviction takes place, to be killed and buried.

14.13 DANGEROUS ANIMALS

It shall be unlawful to keep any lion, tiger, leopard, ocelot, jaguar, cheetah, margay, mountain lion, canada lynx, bobcat, jaguarundi, hyena, wolf, coyote, skunk, poisonous reptile, alligator, crocodile, bear, or boa constrictor.

It shall be unlawful for any person to sell any of the above mentioned animals.

It is no defense to a violation of this section that any animal or poisonous reptile which Is prohibited by this section has been domesticated.

14.14 HUNTING PROHIBITED

No person shall hunt within the territorial limits of the City of Hickory Hills.

14.15 ANIMAL CONTROL AND WELFARE OFFICER

The Mayor may appoint an Animal Control and Welfare Officer, with the advice and consent of the City Council, for a term of one year commencing on May 1. Such officer shall be a special police officer for the purpose of enforcing the provisions of this chapter, under the supervision of the Chief of Police, with authority to make all necessary arrests in the enforcement of this chapter.

14.16 POUNDKEEPER

The Mayor is hereby authorized and empowered to designate such individual or corporation, whether residing within or without the boundaries of this city, to act as poundkeeper.
